The Process Of Recovery

Who is entitled to excess proceeds? Property owners or lienholders are entitled to claim excess proceeds from a tax or foreclosure sale. If there are multiple owners they must agree on how to divide the funds or obtain a court order to distribute the funds. The various taxing units are also entitled to file an additional post-judgment claim from the excess proceeds held in the court registry for subsequent accrued unpaid taxes relating to tax years not included in their original property tax suit.

Once all documents has been received and claim has been submitted. We will continually follow-up with the county to check on the processing time. During the processing phase you will be notified of any updates.

Claim Research

Once eligibility is determined we enter the research phase. This is where we determine the documents needed to be filed with the appropriate county district court.

Provide Documentation and Claim Submission

Once the research phase has concluded you will be contacted to provide the necessary documents proving your ownership or heirship rights. These documents may include deed, lien releases, heirship affidavits etc. Each district court typically has specific documentation and supporting evidence required for recovery. There may be court or filing fees, as well as administrative and processing fees required for document filings or document extractions.

If there are multiple claims on the proceeds a court hearing may be required to determine ownership rights of the rightful owner. You will be informed of any court appearances needed, whether they are conducted by zoom, an in-person court appearance or a telephone conference call directly with the judge.

Payment is Issued

Once the county has completed the processing phase and payment has been issued you will be notified when your payment will be mailed.
